Press Release from the Colombian Caravana of Jurists on the Situation of Extreme Violence Unleashed in Catatumbo

The Eighth International Caravana of Jurists, which traveled to Colombia in August 2024, expresses its deep concern about the extreme violence unleashed in the clashes between illegal armed groups, including the ELN and FARC dissidents. This escalation of violence has created a serious humanitarian crisis and has led the Colombian Government to halt peace talks with the ELN.
In August 2024, the Caravana conducted a monitoring mission in Colombia, where two of its delegations traveled to the Norte de Santander region. One delegation went to the heart of Catatumbo, to La Pista (Tibú), to accompany community resistance processes and document human rights violations. This was carried out within the framework of the Meeting of Victims of Genocidal Processes, which commemorated the La Gabarra Massacre. The other delegation was at the Colombian-Venezuelan border and aimed to assess the implementation of the Peace Agreement and the human rights conditions in regions affected by armed conflict.
During the visit to Norte de Santander, the Caravana was able to confirm the increasing complexity of the violence experienced in this region. This complexity is due to the high presence of illegal armed groups, particularly in the Catatumbo area, and the permeability of the border with Venezuela, where more than 30 illegal crossings exist, and serious human rights violations occur.
The recent escalation of the violence in this region has worsened the situation. It has created a humanitarian crisis characterized by an increase in forced internal displacement and confinement. Human rights organizations in the area have informed the Caravana that communities face extremely difficult and painful circumstances. Over 80 people have been killed and approximately 32,000 have been displaced, including women, the elderly and children. This situation has highlighted the depth and severity of the human impact of this conflict.
Furthermore, threats and harassment against communities, signatories of the Peace Agreement, and social leaders have intensified, leading the Colombian Government to declare a state of internal commotion. It is important to note that this measure had not been implemented for 17 years, further demonstrating the extreme gravity of the current situation.
The serious human rights violations and breaches of international humanitarian law reported in the region could also constitute international crimes, in accordance with international norms and current domestic legislation in Colombia.
The International Caravana of Jurists condemns these grave events, expresses its solidarity with the victims and calls on all parties involved to respect human rights and international humanitarian law. It also urges illegal armed groups to immediately cease hostilities and begin a sincere and committed peace dialogue. On the other hand, we call on the international community to support the Colombian Government in seeking sustainable solutions that will allow the resumption of the peace process and ensure effective protection for the most affected communities.
The International Caravana of Jurists believes that the situation in Norte de Santander requires an urgent and coordinated response from the various institutions that exist for this purpose within the international community. Addressing the humanitarian crisis is both indispensable and urgent. Peace in Colombia cannot remain an unfulfilled aspiration. Colombia deserves a future of peace and justice.
The Caravana reaffirms its commitment to supporting and backing all initiatives aimed at achieving this goal.

Comunicado de la Caravana Internacional de Juristas ante la violencia extrema desatada en el Catatumbo

La Octava Caravana Internacional de Juristas, que viajó a Colombia en agosto de 2024, expresa su profunda preocupación por la extrema violencia desatada en los enfrentamientos entre grupos armados ilegales, que incluyen al ELN y las disidencias de las FARC. Esta escalada de violencia ha generado una grave crisis humanitaria y ha llevado al Gobierno de Colombia a frenar los diálogos de paz con el ELN.
En agosto de 2024, la Caravana realizó una misión de monitoreo en Colombia donde dos de sus delegaciones viajaron a la región de Norte de Santander. Una delegación viajó al corazón del Catatumbo en la Pista (Tibú) a acompañar los procesos comunitarios de resistencia y a documentar las violaciones de derechos humanos. Ello se realizó en el marco del Encuentro de Víctimas de Procesos Genocidas que conmemoró la Masacre de la Gabarra. La otra delegación, estuvo en la frontera colombo-venezolana y su objetivo fue evaluar el cumplimiento del Acuerdo de Paz y las condiciones de los derechos humanos en regiones afectadas por el conflicto armado.
Durante nuestra visita a la región del Norte de Santander pudimos constatar la creciente complejidad de la violencia debido a la alta presencia de grupos armados ilegales, particularmente en la zona del Catatumbo, y la permeabilidad de la frontera con Venezuela, donde existen más de 30 cruces ilegales donde ocurren graves violaciones a los derechos humanos.
El incremento reciente de la violencia en esta región ha agravado la situación, generando una crisis humanitaria caracterizada por un aumento en los desplazamientos internos forzados y los confinamientos.
Los colectivos de derechos humanos en la zona nos han informado que las comunidades enfrentan circunstancias extremadamente difíciles y dolorosas. Más de 80 personas han sido asesinadas y aproximadamente 32,000 han sido desplazadas, incluyendo mujeres, adultos mayores y niños, niñas y adolescentes (NNA), lo que subraya la profundidad y severidad del impacto humano de este conflicto. Asimismo, las amenazas y los hostigamientos contra comunidades, firmantes del Acuerdo de Paz y líderes sociales se han intensificado, llevando al Gobierno de Colombia a declarar el estado de conmoción interna. Es importante destacar que esta medida no se implementaba desde hace 17 años, lo que evidencia la extrema gravedad de la situación actual.
Las graves violaciones a los derechos humanos y al derecho internacional humanitario que se han reportado hasta el momento en la región, a raíz de la escalada de violencia, podrían también constituir crímenes de carácter internacional, de acuerdo con lo establecido en la normativa internacional y la legislación interna vigente en Colombia.
La Caravana Internacional de Juristas condena estos gravísimos hechos, muestra su solidaridad con las víctimas, y hace un llamado a todas las partes involucradas en el conflicto a respetar los derechos humanos y el derecho internacional humanitario.
Asimismo, insta a los grupos armados ilegales a cesar de manera inmediata los enfrentamientos y a iniciar un diálogo de paz sincero y comprometido. Por otro lado, exhortamos a la comunidad internacional a apoyar al Gobierno de Colombia en la búsqueda de soluciones sostenibles que permitan reanudar el proceso de paz y garantizar una protección efectiva a las comunidades más afectadas.
La Caravana Internacional de Juristas considera que la situación en el Norte de Santander requiere una respuesta urgente y coordinada de las diferentes instituciones que para tal fin existen en la comunidad internacional.
Es indispensable y apremiante abordar la crisis humanitaria. La paz en Colombia no puede seguir siendo una aspiración inconclusa. Colombia merece un futuro de paz y justicia.
